Terms of Use

Welcome to MyEverLife. These Terms of Use ("Terms") are an agreement between you and MyEverLife Inc. ("MyEverLife," "we," "us") governing your use of the MyEverLife app and myeverlife.com (the "Service"). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

Please read Sections 7 and 9 carefully. MyEverLife helps you preserve and share your story, but it is not a law firm, and it is not a substitute for a legally valid will or estate plan. Your EverMe is an AI representation built from your words — not the person.

1. Who can use MyEverLife

You must be at least 18 years old (or the age of majority where you live) to use the Service. By using it, you confirm that you meet this requirement and that the information you provide is accurate.

2. Your account

You're responsible for the activity on your account and for keeping your login secure. Tell us promptly if you suspect unauthorized use. You may not use the Service on behalf of someone else without authority to do so.

3. Subscriptions and billing

MyEverLife offers a free tier, paid subscriptions, and one-time Legacy memberships arranged through approved Legacy Advisors. In-app subscriptions are billed through your Apple ID and managed in your Apple subscription settings. Advisor-assisted monthly memberships are billed by Stripe and may include separate private accounts for a household. Subscriptions renew automatically for the same period unless cancelled before renewal. Except where required by law or the payment provider's policies, payments are non-refundable. Prices and plan features may change; we'll give notice of material changes as required.

Cancellation is not account deletion. Cancelling turns off automatic renewal. Paid access continues through the period already paid for. When that period ends, the account moves to our protected free level: existing content is not deleted; existing Vault files remain available; and EverMessages sealed while the membership was active retain their chosen delivery dates. New activity follows the limits of the free plan, and paid-cost services such as new voice generation and face-to-face avatar conversations pause until a paid membership resumes.

If one person pays for a household membership, cancellation affects paid features for every included account at the end of the paid period. Each account remains separate and private. We may notify activated account holders so they know the effective date and can continue independently. The purchaser does not gain access to another account holder's content.

4. Your content and ownership

Your content — your answers, messages, recordings, imported text, photos, and documents — is yours. You grant MyEverLife a limited license to host, store, process, transmit, and display your content solely to operate and provide the Service to you and the recipients you designate (for example, to deliver a scheduled message or to generate your EverMe's replies). We do not sell your content, and we do not use your personal content to train our own general AI models. You're responsible for the content you provide and for having the right to share it.

5. Acceptable use

Please don't use the Service to: break the law; upload content you don't have the right to share; impersonate someone; harass, threaten, or harm others; upload malware; attempt to breach security or access other users' data; or clone a voice that is not your own without that person's consent. We may suspend or remove content or accounts that violate these Terms.

6. Invitations and other people

When you invite recipients, executors, or family members, you confirm you have a good-faith basis to contact them. You're responsible for the accuracy of recipient details. It's your responsibility to keep delivery information current so messages reach the right people.

7. Time-released messages — important

A core feature schedules messages for future delivery. Cancelling a paid subscription does not cancel an EverMessage that was already sealed: it retains its chosen delivery date unless you cancel the message or delete the account. We use reasonable efforts to deliver messages, but delivery depends on factors outside our control — including the recipient's email remaining valid, third-party email systems, and the continued operation of the Service. We do not guarantee delivery at a specific future time, over very long horizons, or in perpetuity, and MyEverLife should not be relied upon as the sole means of conveying time-critical or legally significant information.

8. Voice, EverMe, and AI

With your consent, MyEverLife can create a model of your own voice and can generate conversational replies as your "EverMe." These features use artificial intelligence and third-party providers. AI output may be imperfect, incomplete, or inaccurate, and an EverMe is a representation drawn from the words you provide — it is not you, and it is not professional advice. You are responsible for reviewing what you choose to preserve and share.

9. The Vault and no legal/financial/medical advice

The Vault lets you store copies of documents and notes about where originals are kept. MyEverLife is not a legal custodian, escrow service, or records authority, and storing a document here does not make it legally effective. Always keep the real originals of wills, powers of attorney, and other important documents safe, and consult qualified professionals. Nothing in the Service is legal, financial, tax, or medical advice.

10. Third-party services

The Service relies on third-party providers (for example for hosting, email, AI, voice, and payments). Your use may also be subject to Apple's terms. We're not responsible for third-party services, and their availability may affect the Service.

11. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or that content will be preserved or delivered without loss.

12. Limitation of liability

To the fullest extent permitted by law, MyEverLife and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, content, profits, or goodwill, arising from or related to your use of the Service. Our total liability for any claim will not exceed the greater of the amount you paid us in the twelve months before the claim or USD $100. Some jurisdictions don't allow certain limitations, so some of these may not apply to you.

13. Indemnification

You agree to indemnify and hold MyEverLife harmless from claims arising out of your content, your use of the Service, or your violation of these Terms or the rights of others.

14. Termination

You may stop using the Service, cancel a paid subscription, or delete your account at any time. Cancelling a subscription preserves the account as described in Section 3. Deleting the account is a separate, destructive request that removes the account's content and cancels undelivered messages; the app explains these effects before accepting the request. We may suspend paid-cost features or access if you violate these Terms or if necessary to protect the Service or others. Some provisions (including Sections 4, 11, 12, and 13) survive termination.

If MyEverLife plans to discontinue the Service, we will use reasonable efforts to provide advance notice and a practical opportunity to export content. This does not change the limitations in Sections 7, 10, 11, and 12.

15. Changes to these Terms

We may update these Terms as the Service evolves. We'll update the "Last updated" date and, for material changes, provide additional notice where appropriate. Continued use after changes take effect means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable there, without regard to conflict-of-laws rules, and you agree to the jurisdiction of the courts of Alberta. This does not remove any mandatory consumer rights or protections you have under the law of the place where you live — including another Canadian province, Quebec, or a U.S. state; those still apply to you.
